1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your use of the APEX GOLF JOURNEYS LTD. website (apexgolfjourneys.com) and your participation in any golf trip, package, or service offered by APEX GOLF JOURNEYS LTD. (“we,” “us,” or “our”). By accessing our website or booking a trip, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Services Overview
APEX GOLF JOURNEYS LTD. provides curated golf travel experiences for groups of 8 to 16 people. Our packages typically include golf course bookings, accommodations, and ground transportation between airports, hotels, and golf courses. We coordinate with trusted local partners to deliver each trip.
Trip packages are offered at a fixed price as described on our website or in your booking confirmation. The fixed price covers the items specified in your package. Any additional services, activities, or add-ons requested beyond the stated package are subject to additional charges, which will be communicated and agreed upon before being arranged.
3. Booking and Payment
3.1 Booking Process
Bookings are initiated through our website or by contacting us directly. A booking is confirmed only when we have received the required deposit and sent you a written booking confirmation. Until confirmation is issued, no contract exists between you and APEX GOLF JOURNEYS LTD..
3.2 Pricing
All prices are quoted in Canadian dollars (CAD) unless otherwise stated. Prices are as listed at the time of booking and are subject to change until a booking is confirmed. Once confirmed, your package price is fixed except as outlined in Section 3.4.
3.3 Deposit and Payment Schedule
A non-refundable deposit of [amount or percentage] is required at the time of booking to secure your trip. The remaining balance is due [number] days prior to your trip departure date. If full payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit.
3.4 Price Adjustments
In rare circumstances, we may need to adjust pricing after confirmation due to significant changes in partner costs, currency fluctuations, or government-imposed taxes or fees. If a price increase exceeds 10% of the original quoted price, you will have the option to cancel with a full refund of all payments made.
4. Cancellations and Refunds
4.1 Cancellation by You
If you need to cancel your booking, the following cancellation policy applies:
More than 120 days before departure: Full refund minus the non-refundable deposit
60 days before departure: 30% refund of total trip cost
Less than 60 days before departure: No refund
Cancellations must be submitted in writing by email. The date we receive your written notice determines which cancellation tier applies.
4.2 Cancellation by Us
We reserve the right to cancel a trip if minimum group size is not met, due to safety concerns, severe weather, or other circumstances beyond our reasonable control. In such cases, you will receive a full refund of all payments made, or the option to transfer your booking to an alternative trip date.
4.3 Participant Substitutions
If a member of your group can no longer attend, you may substitute another participant at no additional charge, provided we are notified in writing at least [number] days before departure and the substitute meets any applicable requirements.
5. Trip Itineraries and Changes
Itineraries provided are planned carefully but are subject to change. Golf course availability, weather conditions, and partner scheduling may require us to modify course selections, tee times, accommodations, or other elements of your trip. We will make every effort to provide alternatives of equal or greater quality and will notify you of material changes as soon as practicable.
APEX GOLF JOURNEYS LTD. is not liable for any changes to itineraries caused by circumstances beyond our control, including but not limited to weather, course closures, road conditions, or partner operational changes.
6. Travel and Health
6.1 Travel Documents
You are responsible for ensuring that you and all members of your group hold valid travel documents (passports, visas, etc.) required for your trip. APEX GOLF JOURNEYS LTD. is not responsible for any costs or consequences arising from inadequate or expired travel documents.
6.2 Travel Insurance
We strongly recommend that all participants purchase comprehensive travel insurance covering trip cancellation, medical emergencies, baggage loss, and personal liability. APEX GOLF JOURNEYS LTD. does not provide travel insurance and is not responsible for losses that would have been covered by an appropriate insurance policy.
6.3 Health and Fitness
Golf trips may involve physical activity, altitude, and varying weather conditions. You are responsible for assessing your own fitness and health. Please inform us of any medical conditions, allergies, or accessibility requirements at the time of booking so we can plan accordingly.
7. Conduct and Responsibility
All participants are expected to conduct themselves respectfully and in accordance with the rules and policies of each golf course, accommodation, and venue visited during the trip. APEX GOLF JOURNEYS LTD. reserves the right to remove any participant whose behaviour is disruptive, dangerous, or in violation of venue policies, without refund.
You are responsible for any damage you cause to property at golf courses, accommodations, or transportation during the trip.
8. Tokens and Trip Extras
APEX GOLF JOURNEYS LTD. may include complimentary extras (“Tokens”) as part of your trip experience. Tokens are provided at our discretion, may vary between trips, and are not guaranteed. Tokens have no cash value and are not exchangeable or refundable. The specific items or experiences included as Tokens are not part of the contracted trip package.
9. Guidebooks and Trip Information
We may provide digital or printed guidebooks with information about the golf courses and destinations included in your trip. While we make every effort to ensure accuracy, course conditions, facilities, and local information may change. Guidebook content is provided for informational purposes only and does not constitute a guarantee of specific conditions or experiences.
10. Intellectual Property
All content on our website and in our materials — including text, images, logos, trip descriptions, guidebooks, and branding — is the property of APEX GOLF JOURNEYS LTD. and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without our prior written consent.
11. Photos and Media
During your trip, we or our partners may take photographs or video for promotional purposes. By participating in an APEX GOLF JOURNEYS LTD. trip, you grant us permission to use such images in our marketing materials, website, and social media. If you prefer not to be photographed, please let us know in writing before your trip and we will make reasonable efforts to accommodate your request.
12. Limitation of Liability
APEX GOLF JOURNEYS LTD. acts as a coordinator and organizer of golf travel experiences. We work with independent third-party partners (golf courses, hotels, transportation providers, and others) to deliver your trip. We are not liable for any injury, loss, damage, delay, or expense arising from the acts, omissions, or negligence of these third-party partners.
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to your trip or use of our services shall not exceed the total amount you paid to APEX GOLF JOURNEYS LTD. for the trip in question.
We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of enjoyment, lost travel time, or additional expenses incurred due to trip changes or cancellations.
13. Force Majeure
APEX GOLF JOURNEYS LTD. is not liable for failure to perform any obligation under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, travel restrictions, labour disputes, or infrastructure failures.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of British Columbia, Canada.
15. Modifications to These Terms
We may update these Terms from time to time. Changes will be posted on our website with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
